i had a hearing w/o representation nov 4th 09, the judge addressed the fact that i don’t have any skills for a different line of work, and knows i can’t do my prior work…he asked me if i had any family, no i don’t, do i live in my own home, yes, but foreclosure is in the next month, reposession of my car and my daughter’s truck are right around the corner…i’m a 52 year old widow, i’ve got emphysema, chronic degenerative disc disease, osteoarthritis, bipolar, depression, and i fall into one of the few categories in ref to a ‘special period’ and my widow’s benefits…he told the ve he wouldn’t be needing her opinion’s after talking with me, he knows i had to fire my rep because they had submitted so much crap (alot of incorrect info in ref to my past jobs, and the names of my meds) and nothing very current…he asked if i wanted to postpone since i finally found a lawyer to take my case 2 days before the hearing…he knows why i fired my rep…friday (2009)i faxed him a letter of dire need to expidite his decision, which he as made, with the ‘writers’..do i have a chance of winning my claim????

Do the VE’s get Autism training ? How can they conclude that an autistic person with meltdowns if pushed beyond narrow range of abilities can have transferrable skills ? By definition, this is a disability in which transferrable skills are impaired and impossible.

My friend Sandy, age 52, 11th grade ed., appeared for an ALJ Hearing. The VE when asked by the judge if he thought she could do her past work, or any other less sedentary work, replied – NO, that with Her multiple impairments, emotional, mental, and physical, and side-effects of strong pain meds, that she could maybe work 8-16 hours per week maximum, – and never reach SGA! – But the Judge said that since she could lift an 8-lb. gallon of milk, – she(the judge) disagreed with the VE, and Sandy was found “unfavorable”!? – What a shock!
