Jonathan my name is Christopher cataldi I ordered your book the other day it’s great I’m having a little problem I was in a car accident in 2013 I had two herniated discs in my neck and two bulging discs in my back I missed no time from work I did physical therapy for about 3 months after work I also got an award I think it was $8,000 from my lawyer flashback to 9/11/15 I am New York City Carpenter I was lifting a cabinet and the top ripped off I heard a pop in my arm I tore my bicep I had the surgery as I was rehabbing and sitting down for a couple of months I had a pain in my hip and a pain in my shoulder I was diagnosed with a torn labrum and also a tear in my shoulder I’m getting therapy for both right now I’m going to need surgery for both. I have a lot of pain in my hip and shoulder also my hands and fingers were getting numb they found nerve damage in my left elbow and in my wrist it’s called carpal tunnel syndrome I’m going to probably need surgery for that too I have pain also in my left elbow and left wrist my question to you is how do I put all that stuff in doctors terminology on my residual functional capacity form ?next week makes one year that I’ve been out of work my Orthopedic who’s been taking care of me for the past year won’t fill out that rfc form for me he’s scared but I think I could get my regular MD to fill it out I’ve been going to him for the last 3 or 4 years but I have to fill the paper out correctly I only have one shot again I have a torn labrum I’m going to need surgery I have a tear in my shoulder I’m going to need surgery and I have nerve damage in my left elbow and my wrist they say it’s carpal tunnel syndrome I already got bicep surgery I’m getting therapy for my hip and shoulder right now I have 4 injuries and the two injuries from 3 years ago in that car accident my 2 herniated discs in my neck and 2 bulging disc in my back how can I translate that in doctors terms on the RFC form does the disability or impairment prevent a patient from standing for 6 to 8 hours ? Can the patient stand at all and if so for how long ? Does the disability or impairment prevent the patient from sitting upright for 6 to 8 hours ? Can the patient sit at all and if so for how long ? If the patient cannot stand and or sit upright for 6 to 8 hours what is the reason ? How far can the patient walk without stopping ? Does the disability or impairment require the patient to lie down during the day ? if yes answer please explain why ? How far can the patient walk without stopping ? Would the patient s disability or impairment prevents him or her from traveling alone ?yes or no and why ? If the patient has any complaints of plain please address the following questions ? what is the nature of the pain ? How frequent is the pain ? How would you describe the pain level ? How would you rate the patients credibility with regards to claims of pain ? Is there any objective medical reason for the pain ? Given your experience with the patient your diagnosis and the patience disability or impairment do you believe he or she could continue or resume work at the current previous employment if not please explain why ? Again my Orthopedic would not help me with any of these questions he’s only doing my surgerys thats it the only question he helped me with was what is your prognosis for the patient he said I should put Guarded ? Can you help me with any of these questions I am also on oxycodone 180 pills a month the medication has been making me tired and drowsy my nerve damage doctor put me on ibuprofen 600 mg one tablet 3 times a day I am a 52 year old male I don’t know how my lawyer is going to present my case he might use the grid rules or might use the RFC form I really don’t know I don’t talk to him a lot but the more ammunition I have the better it is for my case if you can help me with any of these questions it would be great I have your book I could take a couple of answers out of that again I have for injuries a torn labrum tear in my shoulder nerve damage in my left elbow and wrist the doctor said it’s carpal tunnel syndrome and I already had bicep surgery I have no plans on going back to work but I cannot collect my union pension unless I have my social security disability it opens all the doors for me again I’ve been out of work for a year now and I have at least 3 more surgeries I have a disability hearing sometime next year I really don’t know when they told me I was 7000 on the list if you can help you with any of these questions it doesn’t have to be today I’ll wait a couple of days or if you would like call me and we could talk a little or you could just email me I’d really appreciate it thank you so much for your time PS I’m also going to pain management that’s where I’m getting my medication from can you please help me ? Chris, I would ask your lawyer to create a custom RFC form that includes all of the limitations you describe. Your lawyer is the best person to do this as he/she would have access to all of your medical records along with your input.
In your response, you stated to have his attorney create a custom RFC form because the attorney would have access to all of his medical records along with his input. What if the attorney or paralegal is unwilling to assist with the forms? Do you recommend getting a different attorney?

Deborah, why is your lawyer refusing to create and submit a functional capacity form? There may be a reason – but I would ask.
